Capacity building for lawyers on National Freedom of Religion or Belief (FoRB) Remedies

Freedom of religion and belief is people’s one of the fundamental Human rights which is ensured by Article 18 of the Universal Declaration of Human Rights. In a democratic country every rightful citizen has the freedom to express their thoughts and practice their believes. But independent practice of religion is an alarming question because of lack of proper knowledge. Raising awareness in the society can really reduce the misconception and can help people to seek proper remedies for any kind of violation of their right.

Religious intolerance is increasing in Bangladesh. Lawyers need information about what to do. Often FoRB is confused with minority rights. Empowerment Through Law of the Common People (ELCOP), a non-profit organization which is administered and managed by the law students and teachers of different universities of Bangladesh, involves those legal experts in its activities who are concerned, have commitment and are competent enough to deal with human rights and empowerment issues. ELCOP has organized a training on Capacity Building for Lawyers on National Freedom of Religion or Belief (FoRB) Remedies.

The project was required because there is no platform for FoRB. The objective of this training was to connect a network between lawyers, academics and activists and to strengthen access to justice for victims of FoRB violations by equipping and supporting lawyers, human rights organizations and faith-based actors to promote FoRB and defend victims.

Outcomes of the training:

  • Focused on the existing human rights law including FoRB, religious minority rights, gender equality from the perspective of national and international laws.
  • Equipped participants with comprehensive understanding of freedom of religion or belief.
  • Enhanced capacities of participants to carry out activities on any type of issues regarding FoRB.
  • Equipped participants with necessary methodological tools to develop a deep knowledge on FoRB based on national and international aspects.
  • Focused on how to apply the existing laws in a case.
  • Focused on country-wide network, which will benefit the participants and the victims of FoRB violation.
  • Had a rippling effect within the communities that participants are coming from.
  • Benefits to the victims. When the victims will understand the difference in the quality of the service they are receiving, they will refer other people to those who are trained through this project.

The inaugural ceremony of the training was held on 23rd April, 2021. Around 50 participants successfully completed this training program.

Barrister Farzana Mahmood, Advocate, Supreme Court of Bangladesh and Executive Director of Bangladesh Manobadhikar O Poribesh Andolon Foundation and Barrister Tapas Kanti Baul, executive director of ELCOP trained the participants via online platform Zoom.

The theme of the training was to build the clear conception on the freedom of religion or beliefs to the lawyers and to the activist. The course was determined to remove the misconception regarding the religious beliefs. The course further expect that the trainee will play an important role in future to protect the freedom of religion.

Training Benefits:

  • Participants got fundamental knowledge about FoRB that how to use different steps to protect the victims;
  • Participants got proper knowledge about following chapters-

 

  1. Handling cases of vested property to ensure the right of land ownership of the religious minorities;
  2. Addressing rape cases and physical violence during communal violence;
  • Taking measures against destruction of temples and houses of religious minorities and land grabbing;
  1. Addressing coercive conversion;
  2. Addressing cases related to hate speech and hurting religious sentiment;
  3. Addressing issues of discrimination in educational institution, work place etc;
  • Using interfaith forum for alternative dispute resolution;
  • Gender equality and FoRB. What can be done in the future?;

 

  • Participants are able to communicate with national and international trainers;
  • Participants get proper knowledge about national and international legal framework regarding these issues.
  • Participants are able to utilize the cases regarding these issues.
  • Participants have got certificate.

 

The closing ceremony of the course on was held on 2nd July, 2021 via online platform Zoom. Kazi Nabil Ahmed, MP was the chief guest of the ceremony. Advocate Rana Das Gupta, General Secretary, Bangladesh Hindu Buddhist Oikya Parishad was the special guest of the ceremony. The ceremony was chaired by the Professor Dr. Mizanur Rahman, chairman of ELCOP and former chairman of National Human Rights Commission (NHRC).Barrister Farzana Mahmood, Advocate, Supreme Court of Bangladesh and Executive Director of Bangladesh Manobadhikar  O Poribesh Andolon Foundation was there to give a light on the whole journey of the training program. And the whole ceremony was presided over by Barrister Tapas KantiBaul, executive director of ELCOP. Dr. Masum Billah, Associate Professor, Department of Law, Jagannath University and Director of Human Rights Summer School, ELCOP gave the vote of thanks. 50 participants of this training program from all over the country joined this ceremony. Cynthia karim, proramme manager of the training was anchoring the whole closing ceremony.
